Event Terms and Conditions
Scope of Application
These Terms and Conditions apply to all public events organised or delivered by the Australian Embassy in Thailand where participation may involve physical activity, health considerations, or elevated personal risk, unless otherwise expressly stated.
1. Definitions
The following words shall have the following definitions:
“Event” means any public event organised or delivered by the Australian Embassy in Thailand that involves physical activity, health considerations, or elevated personal risk.
“Organiser” means the Australian Embassy in Thailand.
“Participant” or “You” means the individual registering for or participating in the Event.
2. Participant Information and Eligibility
2.1 By registering for the Event, You represent and warrant that all information provided to the Organiser is true, accurate, and complete.
2.2 You are at least 18 years of age or have obtained valid consent from a parent or legal guardian to participate in the Event.
2.3 The Organiser reserves the absolute right to deny or revoke your participation in the Event at its sole discretion.
3. Express Assumption of Risk
3.1 You acknowledge and agree that participation in fitness, recreational, or other physical activities involves inherent and significant risks, including but not limited to serious bodily injury, permanent disability, or death.
3.2 You voluntarily and knowingly assume all such risks, whether known or unknown, foreseeable and unforeseeable.
4. Waiver and Release of Liability
4.1 To the fullest extent permitted under applicable law, you hereby irrevocably waive, release, and discharge the Organiser, their directors, officers, employees, instructors, agents, and affiliates from any and all claims, demands, damages, losses, liabilities, costs, and expenses of any kind arising from your participation in the Event.
4.2 This waiver applies to all claims, including those arising from negligence, except where such liability cannot be excluded under Thai law, including liability for gross negligence or willful misconduct under the Civil and Commercial Code of Thailand.
5. Indemnity
5.1 You agree to fully indemnify, defend, and hold harmless the Organiser (including its directors, officers, employees, instructors, agents), and affiliates from and against any claims, liabilities, damages, costs, or expenses (including legal fees) arising out of:
- Your participation in the Event;
- Your breach of these terms; or
- Your negligent, reckless, or intentional acts.
6. Limitation of Liability
6.1 To the maximum extent permitted by law:
- The Organiser shall not be liable for any indirect, incidental, consequential, special, or punitive damages.
- The total aggregate liability of the Organiser with respect to the Event(s), if any, shall be strictly limited to the maximum extent permitted under Thai Law.
- This limitation applies regardless of the legal theory of liability.
7. Strict Compliance and Removal
7.1 You agree to strictly follow all safety instructions and rules given by the Organiser or its employee(s).
7.2 The Organiser may immediately suspend or remove you from the Event if, in its sole judgment, your participation in the Event poses any risk or disruption.
8. Personal Property Disclaimer
8.1 You are solely responsible for your personal belongings at the Event. The Organiser shall have no liability whatsoever for any loss, theft, or damage to personal property, however caused.
9. Changes
9.1 The Organiser reserves the right to modify schedules, instructors, or venues for the Event at any time without liability.
10. Force Majeure
10.1 The Organiser shall bear no liability for any failure or delay caused by events beyond its reasonable control, including government orders, pandemics, or facility closures.
11. Severability
11.1 If any provision in these terms and conditions is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
12. Governing Law and Jurisdiction
12.1 These terms and conditions shall be governed by the laws of Thailand.
12.2 Any disputes between you and the Organiser regarding the Event or these Terms and Conditions shall fall under the exclusive jurisdiction of Thai courts.
13. Binding Acceptance
13.1 By registering for the Event, you confirm that you have read, understood, and agreed to these terms and conditions, and that this constitutes a legally binding agreement between you and the Organiser.
Personal Data Protection Notice
Your personal data will be handled in accordance with applicable law, including the Personal Data Protection Act B.E. 2562 (PDPA).
1. Personal Data Collected
The Organiser does not collect registration information or other personal data from participants for the Event.
However, photographs, video recordings, or other audio‑visual recordings may be taken during the Event in which identifiable individuals may appear. Such images or recordings may constitute personal data under the PDPA.
2. Purposes of Collection and Use
Photographs and recordings may be collected and used by the Organiser for the following purposes:
- Documentation and reporting of Organiser activities; and
- Publication on the Organiser’s website, official social media channels, reports, newsletters, or other official Embassy publications.
3. Disclosure of Personal Data
Photographs and recordings may be accessed by the Organiser’s authorised personnel and, where necessary, by service providers engaged to support the Organiser’s official communications or publications.
The Organiser will not disclose personal data to third parties except where required or permitted by law.
4. Retention Period
Photographs and recordings will be retained only for as long as reasonably necessary to fulfil the purposes stated in this Notice or as required under applicable law, after which they will be securely deleted or anonymised.
5. Rights under the PDPA
Under the PDPA, you have the right to:
- Request access to your personal data;
- Receive your personal data in machine readable format;
- Request correction of inaccurate personal data;
- Request deletion or anonymisation of your personal data;
- Restrict or object to the processing of your personal data;
- Withdraw your consent at any time;
- Lodge a complaint with the relevant authority.
6. Withdrawing Consent

Withdrawal will not affect the lawfulness of data processing based on consent given before withdrawal.
